Terms of service

These terms govern your use of kmfancygold.com and any purchase you make from it. The site is owned and operated by KM Trading (trading as KM Fancy Gold), a sole proprietorship of Najmal P C, licensed by Kuttiadi Grama Panchayat, at 5-53/H, Kuttiadi, Kozhikode, Kerala 673508, India. In these terms, we, us and our refer to KM Trading, and you refers to the customer using the site.

By browsing this site or placing an order you agree to these terms. If you do not agree with them, please do not use the site.

Eligibility

You must be at least 18 years of age, or be using the site under the supervision of a parent or guardian, and you must be able to enter into a binding contract under the Indian Contract Act, 1872.

Products, descriptions and images

We sell fashion and imitation jewellery. Our products are not hallmarked precious metal and are not sold as gold, silver or precious stone jewellery unless a product page expressly says so. Descriptions such as gold plated, gold tone or fancy gold refer to the finish and appearance of the item, not to its metal content.

We take care to describe and photograph our products accurately. Colours may appear slightly different on different screens, and hand-finished items may vary a little from the photograph. Such minor variation is not a defect.

Pricing and availability

All prices are shown in Indian Rupees and include all applicable charges. We may change prices, withdraw products, or limit quantities at any time without notice. If a product is listed at an incorrect price because of a technical or typographical error, we may cancel the order and refund you in full.

Orders

Your order is an offer to buy. A contract is formed only when we confirm and dispatch the order. We may refuse or cancel any order, including where the product is unavailable, where there is an error in the listing, or where we suspect fraudulent or abusive activity. If we cancel a paid order, you receive a full refund.

Payment

Payments are processed by our payment partners over their secure systems. We do not store your card, UPI or bank details on our servers.

Delivery, returns and refunds

Delivery is covered by our Shipping policy, and returns and refunds by our Return and refund policy. Both form part of these terms.

Care and use

Fashion jewellery is delicate. Keep items away from water, perfume, sweat, cosmetics and cleaning agents, and store them dry and separately. We are not responsible for tarnishing, discolouration or damage caused by wear, misuse or improper storage.

Use of the site

All content on this site, including text, images, product photography, logos and design, belongs to KM Trading or is used with permission, and may not be copied or reused without our written consent. You agree not to use the site unlawfully, to interfere with its operation, or to attempt to gain unauthorised access to any part of it.

Accounts

If you create an account, you are responsible for the activity that takes place under it and for keeping your login details secure. Please tell us at once if you believe your account has been used without your permission.

Liability

To the extent permitted by law, our liability in connection with any product or order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss. Nothing in these terms limits any right you have under the Consumer Protection Act, 2019.

Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, including courier disruption, natural events, strikes, or failures of communication networks.

Governing law

These terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts at Kozhikode, Kerala.

Changes

We may update these terms from time to time. The version published on this page at the time you place an order is the version that applies to that order.
